These Terms of Service (“Terms”) govern your use of www.pretzelation.nz operated by Pretzelation (“we”, “us”, “our”). 

By accessing or using our website and services, you agree to these Terms. 

2. Eligibility 

You must be at least 18 years old (or have parental consent) to use our services. 

3. User Accounts 

3.1 Account Creation 

To access certain features, you must create an account and provide accurate information. 

3.2 Account Responsibility 

You agree to: 

  • Keep your login details secure 
  • Be responsible for all activity under your account 
  • Notify us immediately of unauthorized use 

We reserve the right to suspend or terminate accounts for misuse. 

4. Products and Services 

We are manufacturer of baked goods. 

We reserve the right to: 

  • Modify or discontinue services 
  • Limit availability 
  • Refuse service where appropriate 

5. Payments and Pricing 

5.1 Pricing 

All prices are listed in NZD unless stated otherwise and include GST where applicable. 

5.2 Payment Processing 

Credit card payments are securely processed via Stripe. 

5.3 Billing Accuracy 

You agree to provide current and accurate payment information. 

6. Refunds and Cancellations 

6.1 Cancellations 

Orders may be cancelled up to 24 hours prior the chosen delivery option, provided preparation has not already begun. 

Once an order has entered preparation or cooking, cancellations are not possible. 

If an order has already been dispatched for delivery, it cannot be cancelled. 

6.2 Order Changes 

Changes to orders (e.g. toppings, address corrections) must be requested immediately after placing the order. 

We will do our best to accommodate changes, but cannot guarantee modifications once preparation has started. 

6.3 Refunds 

We comply with the Consumer Guarantees Act 1993 and Fair Trading Act 1986, which means: 

You may be entitled to a refund, replacement, or redelivery if: 

  • Your order is incorrect 
  • Your order is significantly delayed beyond reasonable expectations 
  • Your order is damaged, spoiled, or not of acceptable quality 

Refunds are not provided for: 

  • Change of mind after preparation has started 
  • Incorrect orders placed by the customer 
  • Minor delays 

6.4 Delivery Issues 

If your order has not arrived within a reasonable time, please contact us as soon as possible. 

In some cases, we may offer:  

  • A replacement order 
  • Store credit 
  • A partial or full refund 

6.5 Failed Deliveries 

If delivery cannot be completed due to:  

  • Incorrect address provided 
  • Customer unavailable to receive the order 

We reserve the right to not provide a refund. 

6.6 Processing Refunds 

Approved refunds will be issued to the original payment method (including Stripe payments). Credit card surcharges are not refundable. Please allow 3–10 business days for processing.

7. Acceptable Use 

You agree not to: 

  • Use the site for unlawful purposes 
  • Interfere with security or functionality 
  • Attempt unauthorised access to accounts or systems 
  • Upload harmful or malicious content 

8. Intellectual Property 

All content on this website (text, graphics, logos, etc.) is owned by Pretzelation or licensed to us. 

You may not reproduce or redistribute content without permission. 

9. Limitation of Liability 

To the extent permitted by law: 

  • We are not liable for indirect, incidental, or consequential damages 
  • Our total liability is limited to the amount you paid us (if any) 

Nothing in these Terms limits your rights under New Zealand consumer law. 

10. Availability of Service 

We do not guarantee uninterrupted or error-free access to our website. 

11. Termination 

We may suspend or terminate your access if you breach these Terms. 

You may stop using our services at any time. 

12. Privacy 

Your use of our services is also governed by our Privacy Policy. 

13. Governing Law 

These Terms are governed by the laws of New Zealand. 

14. Changes to Terms 

We may update these Terms at any time. Continued use constitutes acceptance.
